MoPeG and Medical Law: The eGbR as a New Option for Medical Collaborations

With the entry into force of the Act on the Modernization of Partnership Law (MoPeG), the choice of the appropriate legal form for medical collaborations has become significantly more important. In particular, the introduction of the registered civil law partnership (eGbR) fundamentally alters the existing legal framework, prompting both new ventures and established partnerships to critically re-evaluate their legal structures.

In their essay, Dr. Wolfgang Krafczyk and Viktor Klyk analyze how the corporate law innovations of the MoPeG impact medical civil law partnerships (GbR), what opportunities and risks the new eGbR presents, and what role it could play in the future within the medical legal context. Their essay is titled: „Die eGbR im Medizinrecht –Eintragung einer ärztlichen GbR empfehlenswert und Etablierung dahingehender Praxis im Kooperationsrecht zu erwarten?“.

Available in the September issue of GesundheitsRecht – Journal for Medical Law, Hospital Law, Pharmacy and Pharmaceutical Law (GesR Volume 24, Issue 9).
